SKRIPSI (6290) - Non-Pecuniary Damages For Passengers Due To Flight Delays By The Airlines
Losses that can be suffered by passengers as consumers due to flight delays can be divided into two forms, namely pecuniary losses and non-pecuniary losses. Along with its development, non-pecuniary losses also include mental turmoil, injuring inner feelings, and all that includes psychological losses. The main objective of this paper is to analyze damage for non-pecuniary losses for passengers in cases of flight delays and the reasons for the Panel of Judges in deciding court decisions relating to non-pecuniary losses in flight delay cases. The research method in this research is legal research with a statute approach, conceptual approach, and case approach. Through this research it is hoped that the concept of non-pecuniary damages in Indonesia can be formed in order to create legal certainty in a court decision. The results of the study confirm that the absence of regulation regarding damage for non-pecuniary damages for unlawful act causes different interpretations of the judge's decision.
