SKRIPSI (6133) - The Obligation For Utilizing Military Robots As Weapons In The Context Of Armed Conflict
The stream of time has allowed the expansion of technology to grow exponentially, especially in the context of robots. The use of robots extends from civilian to military applications. in the military sense, robots are used as weapons based on different command and control systems (C2) ranging from non-autonomous system to the degree where robots can hold fully autonomous system. Due to the nature of military robots that possess a series of complex autonomy, the question raised from this issue is how the user may satisfy the obligation under the International Humanitarian Law (IHL) since there is no specific convention to cover the use of military robots as weapons under the international law. Marten’s clause prescribed that in such cases where the conduct of warfare is yet to be regulated, the preexisting rules should be used as the reference. Therefore, the author uses two approaches for this bachelor thesis, such as the statute approach by looking at the convention and protocols under the IHL, and the conceptual approach by looking at the principles and doctrines under IHL. Based on the findings of whether robots may have the autonomous or non-autonomous system on board, and whether the user is a high contracting party or non-state organized armed group, human is still obliged to evaluate the use of military robots and be responsible for their usage. Nevertheless, studies and discussions related to the user responsibility and ethical use of robots should not be neglected and must be developed.
