TESIS (4263) - Perlindungan Hukum Terhadap Konsumen Transaksi Elektronik di Kota Dili Timor Leste
ABSTRACT
Díli is the capital city of Timor-Leste. The city of Dili is inhabited by residents from various other small towns in Timor-Leste and there are also foreigners coming from various countries with various interests and living in the city of Díli.
As the population continues to grow, Díli is becoming a fairly dense city. As the result, various types of businesses have emerged in which lead to the economic level and influencing people's lifestyles in the city of Díli. This is accompanied by the development of technology, information and communication which is increasingly fast making all needs become easier. As the consequence, most people begin to interact in cyberspace using the internet and electronic means in transacting, with some influences that occur due to developments of the technological aspect, electronic transaction activities arise. Thus, legal issues arise, such as: (1). the comparison of law between Timor-Leste and Indonesia for the solution of the rights and obligations of producers and consumers in electronic transactions and, (2).the government's responsibility for the problem of the electronic transactions selling in Timor-Leste. This research is a legal research which is realized in form of historical, statutory, conceptual, and comparative approach.
Based on the results of the study, it can be concluded that in Timor-Leste there is already exist consumer protection law, unfortunately, there are no special regulations governing electronic transactions, besides that there is no special institution that handles consumer dispute resolution in terms of electronic transactions to accommodate consumer complaints. Many consumers do not yet know on the protection of their rights. The absence of efforts to resolve disputes in electronic transactions, due to the lack socialization of the government regarding the consumer’s protection law, resulted the consumers still not understand about their protected rights, as well as the procedure for filing claims for the losses suffered and, efforts are still required to improve the national legal system and the development of new legal regulations in order to oversee the increasing development of e-commerce trade.
