DISERTASI (307) - Pertanggungjawaban Pidana Media Massa Siber Di Era Kebebasan Informasi
Cyber media is recognized by the Press Council as part of the press according to the
Press Law. However, cyber media is changing the communication patterns of
conventional press media, which broadcast information in a controlled manner, to a
media that is more interactive and spreads faster. Cyber media is also more vulnerable
to ethical and legal issues. To maintain the spirit of freedom of the press, a regulatory
approach is needed that does not impede press freedom guaranteed by the constitution.
In addition, the law guarantees that the national press is not subject to censorship,
bans, and broadcast bans. Therefore, criminal law should be placed as an ultimum
remedium or ultima ratio. Among other approaches to the criminal justice system for
the "dismissal process" of press cases. On the other hand, the current era of freedom
of information needs to be balanced with greater responsibility of fairness in
information digital footprints. As a counterweight to the strengthening of the right to
be forgotten, it is necessary to develop the right of update or the right to be remembered
fairly.
