ABSTRACT
CRIMINAL JUSTICE SYSTEM IN THE CONTEXT TACKLING NARCOTICS ABUSERS

This research is titled " Criminal Justice System in the Context Tackling Narcotics Abusers". The purpose of this research is to find and analyze the ratio legis of rehabilitation arrangements for narcotics abusers as well as to find and analyze new legal principles of criminal justice system, especially for narcotics abusers. While the advantages of this research is for developing the law system specifically, relating to the concept of rehabilitation and the criminal justice system in narcotic crime, providing a new understanding of the urgency of implementing rehabilitation of drug users in the practice of law enforcement to prevent and exterminate drug abuse and give some suggestions in criminal law enforcement against narcotic abusers through the criminal justice system with restorative justice approach and plea bargaining. Type of legal research that is used in this dissertation is a normative legal research. Case approach that is used in this research is the approach to the law (statute approach), case approach and conceptual approach. The conclusions of this research is the philosophy of rehabilitation arrangements for the narcotics abusers are based on two (2) things that narcotics abuser is the perpetrator and victim of drug abuse and drug abusers are addicted and should have been rehabilitated and having social rehabilitation and the application of rehabilitation of drug abusers as forms of punishment carried out by a combined approach of restorative justice and plea bargaining. The suggestions that can be given by writing this research are the urgency to reform the punishments for narcotics abusers using rehabilitation approach and legal drafter should reform some regulations at the level of positive law to ensure the implementation of the process of criminal prosecution in favor of the narcotics abusers.
